Таковы ближайшие последствия принятия (точнее, вступления в силу с 1 января этого года) Закона Украины «Про громадські об’єднання» (дальше – Закон). Принятого, кстати, по инициативе нескольких наиболее успешных на грантовой ниве общественных организаций Украины.
Указанные выше проблемы связаны с двумя нормами этого Закона.
В соответствии с пунктом первым части пятой статьи 10 Закона собственное название общественного объединения не может содержать наименование органа государственной власти, органа власти Автономной Республики Крым, органа местного самоуправления, составных наименований этих органов (министерство, агентство, служба, инспекция, комитет, администрация, прокуратура, суд). Правда, согласно пункта пятого переходных положений Закона требования статьи 10 не распространяются на общественные организации, зарегистрированные до вступления этого закона в силу, но … только до принятия ими решений об изменении названия. А пункт 4 Переходных положений обязывает общественные объединения привести свои уставы в соответствие с Законом в течение 5 лет.
В Украине о правоприменительной практике – речь особая. Самый точный логический анализ не позволит предсказать, как будут трактовать эти нормы чиновники местных управлений Минюста. Но есть основания для опасения, что 1 января 2018 года они заявят, что слова «комитет» в названии «Комитет избирателей Украины» быть не должно. И потребуют это слово из названия убрать. Как, впрочем, и из названий еще 11 общественных организаций, зарегистрированных Главным управлением юстиции в Луганской области на сентябрь 2009 года (то есть, организаций с указанным регионом деятельности – Луганская область). В названиях еще 6 луганских областных организаций используются слова «служба» или «службы», в названиях 5 – слово «агентство». И многие из этих 33 организаций весьма активны и известны в регионе. Понятно, что речь в этом случае идет «всего лишь» об изменении названия. С последующим внесением изменений в учетные данные в налоговой инспекции, пенсионном и других фондах, внесением изменений в реестр неприбыльных организаций, изготовлением новых печатей и штампов, оформлением карточек подписей для банков. Но даже не это главное. Разве не понятно, как важен для КВУ раскрученный за 20 лет деятельности брэнд? В котором слово комитет – ключевое. А символика? А грантовая история?
Еще больше проблем третьему сектору «обещает» часть вторая статьи 13 Закона: «Обособленные подразделения общественного объединения не являются юридическими лицами». А пункт 8 Переходных положений Закона предписывает: «Правовой статус местных ячеек общественных организаций, которые действовали со статусом юридического лица на день введения этого Закона в действие, должен быть приведен в соответствие с настоящим Законом в течение пяти лет со дня введения его в действие. Решение о прекращении таких ячеек как юридических лиц принимается высшим органом управления общественной организации».
То есть, собрание (или конференция) членов ЛОО ВОО КИУ в течение пяти лет должно сделать харакири своей организации – отказаться от собственных грантовых (и не грантовых) проектов, закрыть (или перерегистрировать) учрежденные СМИ и предприятия, передать на баланс в вышестоящую организацию имущество. И пр.
И эта проблема – не только КИУ. Например, в общественный совет при Луганской ОГА входят представители 15 подобных организаций-отделений. А среди общественных организаций, зарегистрированных Главным управлением юстиции в Луганской области на сентябрь 2009 года, их 159 из 807. Еще большая доля их в районах и городах. Да, это наследие СССР, когда общественные организации создавались с тотальной структурой – от столицы до каждого райцентра. И формирования-матрешки, когда общественные организации – юрлица де-юре входили в состав других общественных организаций – юрлиц, особенно активно регистрировались в Луганской области именно в 1992-1994 годах. Однако, это реальный (и «живой») третий сектор Украины, который теперь безжалостно пущен под нож «реформаторов». Ведь в ближайшее годы в областных и районных центрах Украины должны прекратить деятельность многие сотни живых и активных общественных организаций, реализующие свои программы и проекты, занимающие свою нишу в общественной жизни своих территорий. Превратившись в представительства — технологические придатки расположенных в других городах структур. Да и сами так называемые сетевые организации, имеющие разветвленную структуру, скорее всего, окажутся в довольно сложной ситуации. Ведь прекратить юридическое лицо в Украине чрезвычайно хлопотное и дорогостоящее занятие, их чаще бросают.
Всех этих страстей легко было бы избежать, если бы в переходных положениях Закона были предусмотрены различные варианты преобразования сетевых НГО. Например, преобразование общественных организаций, в состав которых входят другие общественные организации – юридические лица, в союзы – путем внесения соответствующих изменений в устав. Или возможность принятия органом управления общественной организации, входящей в состав другой общественной организации, решения о выходе из нее. Опять-таки путем внесения изменения в устав. Но увы, Закон был принят в таком виде, что больше напоминает попытку избавиться от части конкурентов в борьбе за уменьшившийся в размерах грантовый пирог.
Впрочем, и те НГО, которые не попадают под жернова статей 10 и 13 Закона, не должны особенно расслабляться, их тоже ждет немало неприятных (или, по крайней мере, хлопотных) сюрпризов. Так, частью первой статьи 11 Закона предусмотрен довольно обширный перечень сведений, которые в обязательном порядке должны содержаться в уставе. Причем таких, каких раньше там, как правило, не было. Например, в уставе должен содержаться порядок отчета руководящих органов, а также порядок обжалования действий руководящих органов, порядок рассмотрения таких жалоб. И такие изменения в обязательном порядке должны быть внесены в уставы в течение пяти лет.
«Холодным душем» может оказаться и часть шестая статьи 3 Закона, которую можно трактовать как запрет общественной организации привлекать своих членов к выполнению платных работ в качестве физических лиц — предпринимателей.
Ну а те организации, которые легализовались путем сообщения об учреждении, должны до 1 июля определить лицо (лиц), уполномоченное представлять организацию. И подать сведения об этом лице (лицах) в уполномоченный орган по вопросам регистрации.
