Зруйновані та пограбовані історичні пам’ятки волають про допомогу. Плачевний стан культурно-історичної спадщини зазвичай пояснюють нестачею фінансування. Проте для її збереження й дослідження фахівцям потрібен, перш за все, відкритий доступ до земельної документації.
Вже більше п'яти років ніхто не може вберегти від руйнації групу курганів віком близько чотирьох тисяч років, яка знаходиться в Лисичанську Луганської області.
Ці поховання в занедбаному стані археологи виявили восени 2006 року. Для проведення рятівних археологічних робіт професор Сергій Санжаров зі Східноукраїнського національного університету імені Володимира Даля зробив відповідну заявку, склав акт про руйнування й додав викопіювання з карти місцевості у відповідному масштабі. Також він подав заявку до Державної служби геодезії, картографії та кадастру з проханням перенесення геодезічної вишки, яка була розташована на одному з курганів.
Після цього колектив археологів і персонально пана Санжарова було звинувачено в незаконному доступі до картографічної інформації. Під час розслідування, яке проводила СБУ, в науковців вилучили всі карти та схеми, включно зі старими матеріалами, які знаходилися у Луганському обласному краєзнавчому музеї.
До сьогоднішнього дня частина могильника залишається недослідженою й потерпає від руйнації. Де ховається проблема й хто може її вирішити?
Охороною культурно-історичної спадщини в Україні опікується держава. Внутрішнє українське законодавство резонує з міжнародним: у 1988 році Україна ратифікувала Конвенцію про охорону всесвітньої культурної й природної спадщини, в 2004 – Європейську конвенцію про охорону археологічної спадщини, а в 2006 році – Конвенцію про охорону підводної культурної спадщини.
Центральний орган охорони культурної спадщини формується в складі Міністерства культури. Йому підпорядковуються обласні, районні органи охорони й структурні підрозділи в складі органів місцевого самоврядування.
Регулюють ці відносини профільні закони – «Про охорону культурної спадщини» та «Про охорону археологічної спадщини», а порядок управління землями, на яких знаходяться об'єкти, які треба охороняти, визначає Земельний кодекс України, прийнятий Верховною Радою в 2002 році. Він визначає, що землі історико-культурного призначення можуть перебувати в державній, комунальній чи приватній власності.
Далі – цікавіше.У лютому 2011 року Рада прийняла Закон України «Про регулювання містобудівної діяльності». Офіційно законотворці позиціонували його як спрямований на впорядкування й спрощення дозвільних процедур під час планування й забудов територій. Неофіційно, в колі фахівців, вважають, що найбільшу вигоду цей документ приніс великим забудовникам. Адже цей нормативно-правовий акт пунктом 19 прикінцевих положень відміняє обов’язкове проведення археологічних експертиз земельних ділянок на етапі проектування.
Щодо практики проведення археологічних експертиз іще до прийняття закону однозначно висловився перший віце-прем’єр міністр України Андрій Клюєв: “Навіщо платити археологам за початок будівництва?”
Скасування цих експертиз не мало би такого нищівного впливу, якби всі пам’ятки історії стояли на обліку. Специфіка ситуації в тому, що більшість із них знаходиться в прихованому стані й може бути виявлена лише після проведення польових робіт.
Наприклад, восени 2010 року під час будівництва приватного житла в Артемівському районі Луганської області був виявлений курган віком близько п'яти тисяч років. Попри те що археологічна експертиза була проведена, вчасно виявити поховання не вдалося через відсутність картографічної інформації та плутанину з межами районів.
Фахові організації готові хоч за власний рахунок проводити частину експертиз. Проте езадіяння фахівців у цьому процесі обмежена з двох боків.
По-перше, участь археологів із фахових громадських організацій як представників громадськості в питаннях охорони культурного надбання розпливчасто регулюється лише статтею вісім Закону України «Про охорону культурної спадщини». У ній вказано, що органи охорони культурної спадщини можуть залучати до роботи за їхньою згодою досвідчених фахівців у сфері охорони культурної спадщини, а також громадян на правах громадських інспекторів для спостереження за станом зберігання та використання пам'яток, їхніх територій і зон охорони....По-друге, такій ініціативі заважає загальна закритість інформації щодо земельних операцій.
Джерелами інформації для роботи з охорони об’єктів археологічного й історичного надбання є дрібномасштабні карти, бажано з прив’язками в системі координат, і дані щодо абсолютних висот розташування. Саме такі карти разом із фотопланами, фотокартами й планами міст дрібних масштабів належать до Переліку відомостей, що становлять службову інформацію. Цей перелік складає Міністерство регіонального розвитку, будівництва та житлово-комунального господарства України.
Якщо вже вести мову про недосліджені кургани й могильники, то більшість із них розташовані вздовж вододілів – найвищих гребенів. Велика їх частина маркована геодезичними вишками, висоти й координати яких є втємниченими згідно з тим же Переліком. Отже, всі курганні могильники в Україні є таємними.
Комізм ситуації полягає в тому, що за допомогою сучасного GPS обладнання, навіть такої роздільної здатності, що знаходиться у вільному продажі, за бажання будь-хто може складати карти й плани в масштабах дрібніших за вказані в Переліку. А програмні комплекси, наприклад Ozy Explorer чи Map Source, дозволяють за лічені секунди не лише переводити координати різних проекцій одна в одну, але й точно прив’язувати до координатних сіток наявні мапи й наносити на них об’єкти з висотами в режимі реального часу в польових умовах. Вже нема що казати про космічні знімки, вільний доступ до яких має кожна людина в мережі Інтернет.
Очевидно, що ступінь оприлюднення містобудівної інформації, що існує сьогодні, не сприяє поліпшенню охорони культурної спадщини. Більш того, часто саме проблеми з обміном і наданням інформації спричиняють додаткові ускладнення в роботі. Наприклад, потребу археологів користуватися обхідними шляхами для пошуку карт, робота без яких неможлива.
Фахівці в галузі охорони історико-культурного надбання звертаються до Міністерства регіонального розвитку, будівництва й житлово-комунального господарства з вимогою відкрити для загального користування нетаємні частини генеральних планів і плани землекористування в дрібних масштабах 1:10 000 1:25 000 як робочих і необхідних у польових дослідженнях, а також карти з указанням висот об’єктів.
