Подводные камни аграрных расписок

На подписи у Президента находится Закон Украины "Об аграрных расписках". У многих специалистов это вызывает скепсис, как с точки зрения готовности судебной системы рассматривать возможные споры, так и с точки зрения возможности кредиторов выдавать деньги под такое обеспечение.

Мы попытаемся рассмотреть это законопроект с точки зрения кредитора и агрария. Начнем с определения терминов.

В законе использован термин "экспертная организация", которая в тексте закона используется только один раз, в ст. 4, где идет речь о спорах, возникающих между заемщиком и кредитором по качеству сельскохозяйственной продукции, указанной в товарной аграрной расписке. Экспертная организация должна иметь соответствующие полномочия, которые определяются законодательством для судебных экспертов. Значит опять только судебные эксперты будут допущены до такой экспертизы. В институте судовых экспертиз не всегда есть специалисты по дорожно-транспортным происшествиям, а теперь нужно будет иметь еще экспертов, которые смогут оценить качество, например, зерна, указанного в товарной аграрной расписке. Во всем мире в судебных инстанциях используются мнение специалистов при рассмотрении споров, в том числе аджастеров и сюрвейеров и спорах в суде по оценке размера ущерба. У нас же принимается во внимание заключение только судебных экспертов. Доходит до абсурда, когда какой-нибудь доктор наук в некоторой области читает лекции и принимает экзамены у будущих судебных экспертов, но затем его мнение в суде не имеет силы. В соответствии со статьей 8 это должны осуществлять специалисты банка или третьи лица. Кто может быть таким специалистом, третьим лицом? Только тот, кто обеспечил страхование будущего урожая. Без страхования будущего урожая расписка становится фикцией, и не один банк не выдаст кредит под такой документ. Следовательно, банки должны будут переложить эти функции на страховые компании, а те, в свою очередь, будут привлекать независимых аджастеров и сюрвейеров, которые должны будут провести предстраховой осмотр перед приемом на страхование, далее контрольные осмотры в период вегетации растений, оценку биологической урожайности или урожайности путем контрольных обмолотов и размер ущерба.

А кто будет контролировать правильность выполнения технологических карт выращивания той или иной культуры (ст. 8)? Это может и должен делать только страховщик на основе предстраховых и контрольных осмотров полей с будущим урожаем при принятия этих рисков на себя, а не какой-то чиновник из отраслевого министерства. Так почему не прописать эти положения сразу же, без всякой двойственности? А кто согласовывал этот документ со страховым рынком? Никто, потому что он готовился кулуарно.

А есть ли такие специалисты на страховом рынке? В октябре с.г. Нацкомфинуслуг в рамках программы IFC "Развития агрострахования в Украине" осуществило подготовку и выпуск первых 34 аджастеров по агрострахованию. Но такое количество специалистов не хватит даже для обеспечение страхования аграрной продукции с господдержкой в соответствии с принятым законом и требованиями Нацкомфинуслуг к страховщикам.

Думаем, что этот закон требует существенной доработки в части отражения всех вопросов страхования будущего урожая, представленного в качестве обеспечения в аграрных расписках. В противном случае, этот закон ляжет на полку, и ни аграрии, и ни кредиторы не будут использовать этот важный инструмент для развития аграрного сектора нашей экономики.
