В последние месяцы в Украине свобода слова несколько раз становилась темой острой борьбы между властью и оппозицией. Но всякий раз она звучала в контексте политических интересов определенной политической силы. Борьба за свободу слова приобретала характер борьбы за ресурсы для бизнеса и власти. Такая борьба ведется достаточно давно и порядком дискредитировала в глазах населения саму ценность свободы вообще и свободы слова, в частности. «ОстроВ» предоставляет слово известному украинскому философу, живущему в Луганске, Александру Еременко. Последние события подвигли его на написание диалога в форме, показавшей свою эффективность со времен Платона. Её главное призвание – пробудить дискуссию для общей выработки позиции, а не для вдалбливания готовой точки зрения.

Верно, я из этих самых – чокнутых фанатов демократии. Вспоминается интервью одного итальянского журналиста, который ещё во времена Перестройки, когда мы поперхнулись первыми глотками свободы, сказал, что на самом деле свобода слова – это такая вещь, которая всегда нуждается в защите. Даже в обществе с давними демократическими традициями всегда существуют силы, которые хотели бы ограничить свободы граждан.
Эти силы должны постоянно чувствовать отпор. Цепные псы демократии всегда должны бодрствовать. Думаю, что позиция, которую я буду защищать в этой статье, не понравится не только явным и тайным противникам демократических прав и свобод, - она не понравится и многим сторонникам демократических ценностей.
Но я хотел бы обратить внимание моих единомышленников на то, что лишь моя позиция является по-настоящему неуязвимой.
Чтобы упростить аргументацию, я в дальнейшем буду говорить, главным образом, о свободе слова, но подразумевать все остальные демократические права и свободы: свободу совести, свободу митингов, демонстраций, собраний, свободу забастовок и т. п. То есть,всё, что будет сказано о свободе слова, следует распространить и на все прочие демократические свободы.
На мой взгляд, в своей аргументации защитники свободы слова, зачастую, занимают стратегически неверную позицию. Они стремятся доказать, что свобода слова необходима, полезна и целесообразна как могучее средство общего улучшения жизни народа и повышения материального благополучия, в частности. Получается что-то вроде того, что при свободе слова, мол, и экономика развивается эффективнее, и люди неуклонно богатеют, и вообще жить становится «лучше и веселее».
В общем, руки прочь от свободы слова – и всяческое материальное изобилие приложится нам.
Во-первых, это неверно, во всяком случае, не всегда верно. Могут быть общества, в которых свобода слова и материальное благополучие соединены, а могут быть общества, в которых эти замечательные вещи разъединены. И в обществах первого типа свобода слова вовсе не обязательно является условием и причиной материального благополучия.
Откровенно говоря, я думаю, что она никогда не является таковым условием. Материальное благополучие является следствием своих собственных оснований, которые к свободе слова не имеют никакого или почти никакого отношения.
Вторая ошибка, в которую впадают защитники тесной связи свободы слова и материального благополучия, следующая. При такой постановке вопроса более высокая и превосходная ценность ставится на службу менее высокой и превосходной. Ибо (здесь я перехожу к основному тезису моей статьи), свобода слова является более значимой социальной ценностью, чем материальное благополучие.
Свобода слова представляет собой самодостаточную и абсолютную ценность. Она необходима не для достижения каких-то высоких и благих целей, она сама по себе есть высшая и благая цель. Она хороша не ради чего-то, более хорошего, она хороша сама по себе. Свобода слова просто должна быть – и точка. Одно из двух: либо мы должны признать что-либо самодостаточной ценностью, либо мы вынуждены будем признать все ценности относительными. Самодостаточная ценность – это то, что существует не ради чего-то другого, а ради самого себя. Не обязательно что-то одно признавать самодостаточной ценностью – можно признать несколько и даже множество таких ценностей. Повторяем, что свобода слова в нашей статье «представительствует» за все остальные демократические права и свободы. Если мы признаём все ценности относительными, это означает, что ни одна из них не является полностью «хорошей»: она хороша или плоха в зависимости от обстоятельств.
Предположим, что мы принимаем первую точку зрения – признаём существование самодостаточных ценностей.
Кажется, что тогда наша позиция легко опровержима.
- Свобода слова сама по себе мне не нужна. Материальное благополучие, вообще достойная жизнь - это другое дело, вот что важно.
- А для чего вам материальное благополучие?
- Как для чего? Без него не будет достойной жизни.
- А достойная жизнь для чего?
- Что значит - "для чего»"? Достойная жизнь сама по себе хороша… Ну ладно, достойная жизнь даёт ощущение счастья.

- Да вы что, ненормальный? Счастье хорошо само по себе. Быть счастливым – это хорошо, а быть несчастным – это плохо, вот и всё, и никаким рассуждениями вы это не опровергнете.
- Значит, вы признаёте, что существует нечто, что хорошо само по себе, и это счастье?
- Несомненно.
- Так вот, я тоже признаю, что существует нечто, что хорошо само по себе, и это свобода. Свобода выше материального благополучия, выше достойной жизни (хотя, без свободы, между прочим, не может быть по-настоящему достойной жизни), выше счастья. Свобода выше самой жизни. В современном обществе существует культ материального благополучия.
Так вот, всем поклонникам золотого тельца хочу привести слова Демокрита: «Бедность в демократии настолько же предпочтительнее так называемого благополучия при царях, насколько свобода лучше рабства».
- Да вы просто псих со своим Демокритом! Здесь спор переходит в недопустимую для интеллектуальной дискуссии плоскость. Теперь предположим, что мы избираем второй путь – отвергаем существование самодостаточных ценностей.
- Что вы прицепились со своей свободой? Все знают, что всё относительно. Если так, то нам будет ещё проще. Хорошо, пусть всё будет относительно. Тогда ни одна социальная ценность не хороша сама по себе и всегда. Нет ничего безусловно хорошего: одни ценности лучше других в одном отношении и хуже в другом; одни лучше в одно время, другие – в другое. Но тогда мы теряем критерии сравнивания ценностей – все они оказываются как бы равноценными. Но тогда – внимание! – мы не можем сказать, что вот эта ценность лучше, а вот эта хуже. Тогда, конечно, я не могу утверждать, что свобода слова выше материального благополучия. Но и вы не можете утверждать, что материальное благополучие, достойная жизнь, счастье и т. п. выше свободы слова. Если не существует ничего, что хорошо само по себе и всегда, то тогда и материальное благополучие, и счастье, и все прочие, любезные сердцу обывателя вещи, не хороши сами по себе и всегда. Почему же следует предпочесть их свободе слово? Если всё относительно, то все мнения равноценны. Очень хорошо, тогда пусть и моё мнение о большей ценности свободы слова по сравнению, скажем, с материальным благополучием будет признано равноценным с обратным мнением.
Логически возможны четыре основных варианта соотношения свободы слова и материального благополучия. Может быть такое общество, в котором и свобода слова существует, и материальное благополучие на высоком уровне.
Второй вариант: когда есть свобода слова, но нет материального благополучия.
Третий вариант: свободы слова нет, но материальное благополучие имеется. Наконец, возможно такое общество, в котором нет ни свободы слова, ни материального благополучия.
Первый вариант и четвёртый мы можем исключить из рассмотрения в силу их банальной понятности. Всякий нормальный человек согласится с тем, что лучше всего быть свободным и богатым, а хуже всего – несвободным и бедным. То, что первый тип общества наилучший, а последний – наихудший - это ясно без комментариев. Поскольку эти варианты неинтересны, мы вправе их игнорировать. Гораздо интереснее вследствие своей неоднозначности промежуточные варианты.
Предположим (только предположим – для чистоты мысленного эксперимента), что мы можем выбирать лишь из двух вариантов: общество бедной свободы или общество богатой несвободы. Что мы предпочтём? Лично я предпочту общество, в котором существует свобода слова, но не существует материального благополучия (вспомним о Демокрите!). Такое общество, безусловно, лучше общества материально благополучного, но без свободы слова. Хотелось бы отвести два напрашивающихся возражения. Прежде всего, критики свободы слова не преминут указать на тот бесспорный факт, что не существует удовлетворительного определения и даже удовлетворительного понимания понятия «свобода».
Не существует чётких критериев свободы. Короче говоря, не совсем ясно, что же такое эта самая свобода. Но тогда мы не можем с достаточной уверенностью утверждать, что вот в этом обществе есть свобода слова, а в этом её нет. Данное возражение является софистическим. Согласен, что нет чётких критериев свободы.
А есть чёткие критерии счастья, здоровья, достойной жизни или вашего излюбленного материального благополучия?
Вы говорите, что неясно, начиная с какой степени ограничения свободы слова мы можем говорить о её отсутствии, а начиная с какой степени вседозволенности прессы – о наличии свободы слова. Хорошо. А начиная с какой степени наличия болячек мы можем говорить, что данный организм больной, а вот тот – здоровый? Начиная с какой суммы денег мы можем говорить, что вот этот человек бедный, а вот тот – богатый?
Вы говорите, что нельзя отличить свободу слова от несвободы. Позвольте: для одного человека коммуналка и общественный транспорт – это вполне нормальные жизненные условия, а другой капризничает оттого, что у него нет особняка в Ницце и яхты.
Ни для чего нет чётких критериев, но это не значит, что мы вообще не можем различать здоровье и болезнь, счастье и несчастье, богатство и бедность. А если различаем, то худо-бедно и свободу от несвободы отличим. Второе возражение наверняка уже давно срывается с языка у оппонентов.
- Ишь ты, голодную свободу он предпочитает! Да врёт, небось, сам, небось, на «Майбахе» ездит, ананасы с рябчиками поглощает, а нам тут втирает! А если автор не врёт, то он просто чокнутый. Если он такой псих, что ему свобода слова дороже нормальной сытой и спокойной жизни, то пусть, по крайней мере, не навязывает своё нелепое мнение всему обществу. Нам, нормальным людям, не навязывает. Дерьмократ паршивый – за свободу слова Родину продаст! А я и не навязываю своё мнение – я его просто высказываю. Я говорю исключительно сам за себя. Я хотел бы, чтобы нашлись в Украине люди, которые со мной согласны и которые добровольно присоединятся к моему мнению. Если не найдётся таких людей, я останусь один со своим мнением. Я никому не собираюсь насильно вдалбливать своё мнение. У меня и возможностей таких нет, а если бы были, всё равно не стал бы.
Пусть я буду чудаком, психом, чокнутым, но я не устану повторять: свобода превыше всего! Свобода хороша сама по себе. Свобода хороша и когда она полезна, и когда она вредна. Свобода вовсе не есть средство для достижения чего-то иного - она есть самодостаточная цель. Да здравствует свобода слова! Пусть рухнет мир, но восторжествует свобода слова! Напоследок хотел бы сказать энтузиастам сытого образа жизни следующее: кто не выбирает свободу, тот выбирает рабство. Компромиссов здесь не может быть. Тот, кто сыт, но несвободен, есть сытый раб. Сытое рабство – тоже рабство. Знайте это. Не делайте вид, что не понимаете этого. Кстати, основная беда, доставшаяся нам в наследство и от царской России, и от социализма это рабство как состояние души. Восточнославянские народы в массе своей вовсе не хотят свободы – они хотят нового ярма. Но я обращаюсь к тебе, мой читатель, именно к тебе. Если все вокруг будут хотеть ярма, ты, кто пытается сейчас сложить эту непослушную, шелестящую на ветру газету, ты, кто, трясясь в маршрутке или качаясь в вагоне, цепляется взглядом за эти прыгающие строчки, ты, мой юный друг, - не хоти ярма.
